Terms & Services

These Terms of Service govern access to and use of the Collective Gaming website, online services, customer accounts, retail services, events, communications, purchases, and other services made available directly by Collective Gaming.

By accessing or using the website, creating an account, placing an order, registering for an event, participating in Collective Gaming services, or otherwise engaging in a transaction with Collective Gaming, you agree to these Terms of Service and any additional policies or terms applicable to the particular service or transaction.

If you do not agree to these Terms of Service, you should not use the website or services.

Terms at a Glance

  • Collective Gaming may refuse service, cancel transactions, or restrict accounts when reasonably necessary to prevent fraud, abuse, misconduct, or security issues.

  • Collective Gaming's original branding, website content, graphics, and materials may not be commercially used without authorization.

  • Customer personal information is handled according to the Privacy Policy.

  • These Terms are generally governed by Arizona law, with legal proceedings brought in Maricopa County where permitted by law.

Eligibility and Acceptable Use

You may use Collective Gaming's website and services only for lawful purposes and in accordance with these Terms.

You are responsible for ensuring that information submitted to Collective Gaming is accurate, current, and complete.

​

You may not:

  • impersonate another person;

  • provide fraudulent or materially false information;

  • use another person's payment information without authorization;

  • interfere with the operation or security of Collective Gaming's website or services;

  • attempt to gain unauthorized access to accounts, systems, or information; or

  • use Collective Gaming services for unlawful, fraudulent, abusive, deceptive, or malicious purposes.

Collective Gaming reserves the right to refuse service, restrict access, suspend or terminate an account, cancel a transaction, or take other reasonable action when necessary to prevent fraud, protect customers or staff, enforce store policies, comply with law, protect the integrity of Collective Gaming's services, or address conduct that violates these Terms.

Customer Accounts

Certain features may require or permit creation of a customer account.

Customers are responsible for:

  • maintaining accurate account information;

  • maintaining the confidentiality of login credentials; and

  • taking reasonable steps to protect their accounts from unauthorized use.

​

Collective Gaming is not responsible for losses resulting from unauthorized account access caused by a customer's failure to reasonably safeguard login credentials, except to the extent otherwise required by law.

​

Customers should promptly notify Collective Gaming if they believe an account has been accessed or used without authorization.

​

Collective Gaming may suspend, restrict, merge, correct, or terminate accounts where reasonably necessary because of:

  • fraud;

  • duplicate accounts;

  • abuse;

  • security concerns;

  • materially inaccurate information;

  • violation of these Terms; or

  • misuse of Collective Gaming programs or services.

Products and Services

Collective Gaming may sell or provide:

  • tabletop games;

  • miniatures;

  • hobby products;

  • gaming accessories;

  • books and supplies;

  • used and pre-owned merchandise;

  • events and organized play;

  • loyalty programs;

  • special orders and preorders; and

  • other related products or services.

Product availability, selection, pricing, promotions, descriptions, photographs, specifications, release information, and other product information may change without notice.

​

Collective Gaming makes reasonable efforts to provide accurate product information but does not guarantee that all descriptions, photographs, colors, dimensions, compatibility information, inventory quantities, release dates, or other details will be error-free or complete.

​

Product photographs may be provided by manufacturers, distributors, suppliers, or Collective Gaming and may not always reflect minor packaging revisions or other nonmaterial differences in the merchandise ultimately received.

Pricing and Listing Errors

Collective Gaming makes reasonable efforts to display accurate prices and product information.

​

Occasionally, a product may be listed with an incorrect:

  • price;

  • description;

  • discount;

  • availability status;

  • quantity;

  • promotional offer; or

  • other product information.

​

Errors may result from typographical mistakes, supplier data, inventory synchronization issues, technical problems, or other circumstances.

​

Collective Gaming reserves the right to correct errors before accepting or fulfilling a transaction.

​

If a material pricing or product error is identified after an order is submitted but before fulfillment, Collective Gaming may contact the customer with the corrected information and provide the opportunity to:

  • proceed under the corrected terms; or

  • cancel the affected item or order.

​

Collective Gaming will not knowingly use pricing errors or misleading information to induce purchases.

Inventory and Availability

Products displayed as available may become unavailable before an order is fulfilled.

​

Inventory discrepancies may result from:

  • simultaneous transactions;

  • theft or loss;

  • damaged merchandise;

  • incorrect inventory counts;

  • receiving discrepancies;

  • system delays;

  • supplier errors; or

  • other circumstances affecting inventory accuracy.

An order confirmation acknowledges receipt of an order and does not guarantee that every item can be fulfilled.

​

When Collective Gaming cannot fulfill an order or portion of an order, the transaction will be handled according to the applicable Pickup & Order Fulfillment Policy, Special Order & Preorder Policy, or other applicable terms.

Payment

Customers agree to provide valid and authorized payment information for purchases.

​

Collective Gaming may use third-party payment processors to process transactions. Payment processing may also be subject to the terms and privacy practices of the applicable payment provider.

​

Collective Gaming may decline, cancel, delay, or require additional verification for a transaction when there is reasonable concern regarding:

  • payment authorization;

  • fraud;

  • chargebacks;

  • identity verification;

  • system errors;

  • unusual transaction activity; or

  • other legitimate security concerns.

​

A pending authorization or charge appearing on a financial account does not necessarily mean that an order has been accepted or fulfilled.

Returns, Refunds, and Final-Sale Merchandise

Returns, exchanges, refunds, and final-sale merchandise are governed by Collective Gaming's Return & Refund Policy, which is incorporated into these Terms by reference.

Certain merchandise may be subject to additional restrictions or may be final sale, including:

  • used or pre-owned merchandise;

  • trading card products;

  • clearance merchandise;

  • items specifically marked Final Sale;

  • opened merchandise;

  • special orders;

  • preorders; and

  • other products identified as nonreturnable.

Customers should review the Return & Refund Policy before completing a purchase.

Special Orders and Preorders

Special orders and preorders are governed by Collective Gaming's Special Order & Preorder Policy.

​

Special orders and preorders may be subject to:

  • full prepayment;

  • allocation limits;

  • supplier availability;

  • release-date changes;

  • cancellation terms;

  • pickup deadlines;

  • final-sale restrictions; and

  • other conditions described in that policy.

​

Submission of a request does not guarantee product availability or fulfillment.

Pickup and Order Fulfillment

Orders designated for in-store pickup are governed by Collective Gaming's Pickup & Order Fulfillment Policy.

​

Customers are responsible for reviewing:

  • pickup notifications;

  • applicable pickup deadlines;

  • verification requirements; and

  • unclaimed-order provisions.

Events, Organized Play, and Gaming Activities

Participation in Collective Gaming tournaments, leagues, organized play, casual gaming activities, hobby events, and other events is governed by the Collective Gaming Event, Player Conduct & Judging Policy.

​

Participants must comply with:

  • applicable game rules;

  • event requirements;

  • conduct expectations;

  • Judge and Tournament Organizer decisions;

  • organized-play requirements; and

  • reasonable staff instructions.

​

Collective Gaming may deny participation, remove a participant, or restrict future participation when reasonably necessary to enforce event rules, protect safety, address cheating or misconduct, or preserve the integrity of an event.

Collective Credits Loyalty & Rewards Program

Participation in the Collective Credits loyalty program is governed by the Collective Credits Loyalty & Rewards Terms.

​

XP, rewards, promotional benefits, and loyalty-program privileges have no cash value except where otherwise required by law.

​

All earning, redemption, expiration, adjustment, transferability, and anti-abuse provisions are governed by the applicable loyalty terms.

Used and Pre-Owned Merchandise

Used and pre-owned merchandise may show signs of prior ownership or use, including:

  • assembly;

  • painting;

  • modification;

  • repair;

  • wear;

  • missing original packaging;

  • replacement components; or

  • other condition differences.

​

Collective Gaming will make reasonable efforts to describe known material condition issues accurately.

​

Unless expressly stated otherwise, Collective Gaming does not guarantee that used merchandise includes every component originally included when the product was new.

​

Customers are responsible for reviewing available photographs, descriptions, condition information, and merchandise before completing a purchase.

​

Used and pre-owned merchandise is sold as-is and is final sale, except where otherwise required by law or where Collective Gaming materially misrepresented the merchandise.

Gift Cards, Store Credit, Promotional Credit, and Rewards

Gift cards, store credit, promotional credits, coupons, discounts, and loyalty rewards are subject to their applicable terms.

​

Unless otherwise required by law, promotional credits, coupons, loyalty rewards, and similar benefits:

  • have no cash value; and

  • may not be redeemed for cash.

​

Collective Gaming may correct balances or reverse benefits issued because of:

  • fraud;

  • technical error;

  • returned purchases;

  • canceled transactions;

  • duplicate credits;

  • chargebacks; or

  • other circumstances where the benefit was not properly earned.

Promotions and Discounts

Promotions may be subject to additional:

  • eligibility requirements;

  • dates;

  • product restrictions;

  • quantity limits;

  • redemption limits; or

  • other terms disclosed with the promotion.

Collective Gaming may modify or discontinue a promotion before a purchase is completed when reasonably necessary because of error, inventory shortage, technical malfunction, fraud, or other legitimate circumstances.

​

Completed transactions remain subject to the promotional terms disclosed at the time of purchase.

Intellectual Property

Unless otherwise stated, the Collective Gaming name, logos, branding, original website content, photographs created by Collective Gaming, graphics, written materials, event materials, promotional content, and other original materials are owned by or licensed to Collective Gaming and are protected by applicable intellectual-property laws.

​

Third-party trademarks, game names, logos, artwork, product images, and other intellectual property remain the property of their respective owners.

​

Nothing on the website grants a customer ownership of or a license to Collective Gaming intellectual property except for the limited right to access and use the website and services for their intended personal purposes.

​

Without authorization, you may not:

  • reproduce;

  • distribute;

  • modify;

  • sell;

  • commercially exploit;

  • impersonate; or

  • otherwise misuse Collective Gaming's protected materials.

Customer Content, Reviews, and Submissions

Customers may have opportunities to submit:

  • reviews;

  • photographs;

  • messages;

  • comments;

  • reports;

  • event information; or

  • other content.

​

Customers retain ownership of content they lawfully own.

​

By voluntarily submitting content to Collective Gaming, the customer grants Collective Gaming a nonexclusive right to use that content for the purpose for which it was provided, including:

  • providing customer service;

  • administering events;

  • addressing complaints;

  • reviewing reports; or

  • displaying reviews where applicable.

​

Customers may not submit content that is unlawful, threatening, defamatory, harassing, infringing, fraudulent, malicious, deceptive, obscene, or otherwise prohibited.

​

Nothing in these Terms prohibits or penalizes a customer for providing an honest review or assessment of Collective Gaming, its products, or its services.

Communications

By providing contact information, customers authorize Collective Gaming to send transactional communications reasonably necessary to administer:

  • purchases;

  • pickups;

  • accounts;

  • events;

  • loyalty activity;

  • security notices;

  • customer-service requests; and

  • other requested services.

​

Promotional email or text communications will be handled according to applicable consent requirements and Collective Gaming's Privacy Policy.

​

Customers may unsubscribe from promotional communications using the methods provided with those communications.

​

Opting out of marketing does not necessarily prevent Collective Gaming from sending transactional, security, account, order, pickup, event, or other service-related communications.

Fraud and Abuse

Collective Gaming may investigate suspected:

  • fraud;

  • theft;

  • payment abuse;

  • chargeback abuse;

  • promotion manipulation;

  • loyalty-program abuse;

  • account manipulation;

  • product tampering;

  • return fraud;

  • event manipulation; or

  • other misuse of Collective Gaming services.

​

Where reasonably supported by the circumstances, Collective Gaming may:

  • cancel transactions;

  • reverse improperly obtained rewards or credits;

  • restrict purchasing privileges;

  • suspend or terminate accounts;

  • refuse service;

  • preserve transaction records; or

  • take other appropriate action.

​

Nothing in these Terms limits Collective Gaming's ability to cooperate with payment processors, financial institutions, law enforcement, courts, regulators, or other appropriate authorities where legally permitted or required.

Chargebacks and Payment Disputes

Customers are encouraged to contact Collective Gaming directly regarding order, billing, cancellation, return, or fulfillment concerns before initiating a chargeback or other payment dispute.

​

Initiating a chargeback does not create an independent right to a refund and does not override applicable purchase, cancellation, or return terms.

​

Collective Gaming may provide relevant information to payment processors or financial institutions when responding to a dispute, including:

  • transaction records;

  • communications;

  • receipts;

  • pickup records;

  • applicable policies; and

  • other relevant documentation.

Third-Party Services and Links

Collective Gaming's website may contain links to or integrations with third-party services.

Collective Gaming does not control and is not responsible for the availability, content, privacy practices, security, accuracy, or independent services of third parties.

​

Use of third-party services may be subject to separate terms and privacy policies between the customer and the applicable third party.

Website Availability

Collective Gaming does not guarantee uninterrupted or error-free operation of the website or digital services.

​

The website may occasionally become unavailable because of:

  • maintenance;

  • technical failures;

  • internet outages;

  • third-party service interruptions;

  • security incidents;

  • updates; or

  • other circumstances outside Collective Gaming's reasonable control.

​

Collective Gaming may modify, suspend, discontinue, replace, or update website functionality from time to time.

Disclaimer of Warranties

To the fullest extent permitted by applicable law, Collective Gaming's website and digital services are provided on an “as available” basis.

​

Except for warranties expressly provided by Collective Gaming or rights that cannot legally be disclaimed, Collective Gaming does not make additional warranties regarding:

  • uninterrupted availability;

  • compatibility;

  • merchantability;

  • fitness for a particular purpose; or

  • error-free operation of the website or services.

​

Nothing in these Terms eliminates or limits manufacturer warranties or consumer protections that cannot legally be waived.

Limitation of Liability

To the fullest extent permitted by applicable law, Collective Gaming will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from:

  • use of the website or services;

  • loss of data;

  • loss of anticipated profits;

  • interruption of service; or

  • circumstances outside Collective Gaming's reasonable control.

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

​

Any limitation of liability will be interpreted and enforced only to the extent permitted by applicable law.

Indemnification

To the extent permitted by law, a user who violates these Terms, misuses Collective Gaming's services, infringes another person's rights, commits fraud, or engages in unlawful conduct agrees to be responsible for losses, liabilities, claims, damages, and reasonable costs directly resulting from that conduct.

This provision does not require a consumer to indemnify Collective Gaming for Collective Gaming's own unlawful conduct, negligence where liability cannot legally be waived, or other matters for which indemnification would be prohibited by law.

Safety and Store Conduct

Customers, players, guests, and participants using Collective Gaming premises or participating in Collective Gaming activities must comply with:

  • reasonable safety instructions;

  • posted policies;

  • event requirements;

  • staff directions; and

  • applicable law.

Collective Gaming reserves the right to require a person to leave the premises or discontinue participation when reasonably necessary because of:

  • threatening behavior;

  • harassment;

  • theft;

  • property damage;

  • intoxication;

  • disruption;

  • safety concerns;

  • fraud; or

  • violation of applicable policies.

Privacy

Collection, use, disclosure, retention, and protection of personal information are governed by Collective Gaming's Privacy Policy.

Customers should review the Privacy Policy before creating an account or using services that require personal information.

Electronic Communications and Agreements

Customers agree that electronic communications, confirmations, policies, notices, and agreements may satisfy requirements that information be provided in writing where permitted by applicable law.

​

Electronic records and signatures may have the same legal effect as paper records and handwritten signatures where recognized by applicable law.

Governing Law and Venue

These Terms and disputes arising from transactions directly with Collective Gaming will generally be governed by the laws of the State of Arizona, without regard to conflict-of-law principles, except where applicable federal law or another mandatory law controls.

To the extent permitted by applicable law, legal proceedings arising from these Terms or Collective Gaming services shall be brought in a court of competent jurisdiction located in Maricopa County, Arizona.

​

Nothing in this provision prevents a consumer from exercising a right to bring a claim in another jurisdiction where applicable law prohibits that right from being waived.

Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be interpreted or limited to the minimum extent necessary to make it enforceable where legally permissible.

The remaining provisions will continue in effect.

No Waiver

Collective Gaming's failure to enforce a provision of these Terms on one occasion does not waive the right to enforce that provision or another provision in the future.

Entire Agreement and Incorporated Policies

These Terms, together with applicable Collective Gaming policies expressly incorporated by reference and any transaction-specific or event-specific terms disclosed before purchase or participation, constitute the applicable agreement between the customer and Collective Gaming concerning the relevant service or transaction.

  • Return & Refund Policy

  • Special Order & Preorder Policy

  • Pickup & Order Fulfillment Policy

  • Event, Player Conduct & Judging Policy

  • Collective Credits Loyalty & Rewards Terms

  • Privacy Policy

Where a specific incorporated policy directly addresses an issue, the more specific policy will generally control over a conflicting general provision in these Terms.

Changes to These Terms

Collective Gaming may update these Terms from time to time to reflect changes in:

  • services;

  • business practices;

  • technology;

  • legal requirements; or

  • other circumstances.

The updated Effective Date will identify the current version.

​

Material changes will generally apply prospectively unless otherwise permitted or required by law.

​

Continued use of Collective Gaming's services after updated Terms become effective constitutes acceptance to the extent permitted by applicable law.
